This is the order of the Ordinary Court of Bologna – or at least the part of it that more interesting to Borile Motorcycles – vote on what we might call the “Scrambler Gate” erupted last October.
Indeed, when Ducati has officially announced its Scrambler, Borile issued a statement vitriolic in which he denounced the treatment by the Bologna company to house artisan, guilty of not having the most respected trade agreement previously taken regarding the development of the Scrambler Borile.
Since that agreement, in fact, times – and ownership of Ducati – had changed and a product that did not seem to attract the Bologna-based company has become then nodal. Ducati has also stated that it has begun development of its Scrambler in 2009, when – according Borile – up to 2011 never made reference to this possibility.
Borile Motorcycles states that he had no intention of offending the image of Ducati, but with its press and with the video shot at the time of the above agreement intended only ask clarity on agreements made and not respected.
Personally I find that some steps are still unclear and for that I can only agree on one thing with Borile Motorcycles: Ducati should make known its position not only through the work of its lawyers, but calmly explaining his case to fans.
